The first thing that a girl learns when she reaches second year at the law school or university, is all is different, quite different from the sophisticated, tender and inspiring words of the spirit of law and virtues and honour…I Everything that a girl knows, everything that a girl has been taught loses its purpose, its meaning. The patient lessons of our professors fade away, replaced by the harsh new reality and the mere need of surviving by being disobedient, not quite sophisticated and pleasing not inside… And everything is changed, save for one – the general principles of law, which seem to be universal, no matter which preambule you are reading and which country you are inhabiting…
There is an old wisdom said by an ancient wage – ius est ars boni et aequi (the law is an art of beauty and virtue).. And it is really so.. The principles of law, perfect in their aim, are really a wonder, created by ideal minds for ideal conditions. And if we were ideal, the world of the Earth would have been a better place to live…and more boring.. Because the Laws are logical and rational, but applied over irrational individuals with illogical behaviour. This is the reason that a law is just a frame of acting, but it cant stop anyone from doing better or worse, or at least to follow the limits given… And in there is hidden the charm of the surprise, the countless nuances of the gray between the two pillars of humanity – the Black and the White. And we are those, who create the variety, by making choices – how to stick to the Law.
But sticking to the Law, to a given order or to a settled restriction also needs to know it. You cant follow a law which You don’t know. It is true that ignorantia legis neminem excusat, but this is where forgiveness appears, and mercy. For the purposes of laws are different – not only to create a frame to be followed and thus to give a freedom that not offend someone else’s freedom, and so – all to be partially restricted in our freedom at the sake of the mutual wellbeing – but also - to remind people in advance – what would be happened to them if they cant respect the others – this is the general prevention that excuses no one, but also saves our heads not to be served on a plate.
One of the fathers of the ancient greek theories of “Crime and punishment” is Aristotelis, who says that it is not wrong an ignorant to make a mistake, to break a law, but it is wrong not to be punished, for he will never learn what is the correct and by not being punished, he will never reach the calocagatia – the mixture of physical and mental beauty in one. So, it is not only a right, but even a human duty of society to punish the offender of the Law – for his own good.
The ancient romans based their Law system after the idea – errare humanum est- and people quote it even today, but many of them forget how it continues – sed perseverare diabolicum est.. And it is really so true. Because everyone mistakes and only the guidance of the wiser in patience and restrictions can lead the girl to the paths of perfection...
